Pictometry's legal dispute against Blom, its  European licensee, began late last year after Blom entered into a Cooperation  Agreement with Infoterra Limited. Pictometry cited a breach by Blom of its  obligations which prohibit Blom from sublicensing Pictometry's exclusive  technology rights or trademarks, or delegating duties to a third party without  prior written consent. In December 2010, an injunction ruling was made,  requiring full compliance with the terms of the technology agreement between the  parties. Pictometry's basis for its current motion is Blom's failure to perform  under that agreement and other grounds it believes are in violation of the  injunction. &lt;br /&gt;&lt;br /&gt;&lt;/p&gt;

Due to the baseless nature of GeoSpan's infringement claims, Pictometry may ask the Minnesota Court to declare the case &quot;exceptional&quot; and require GeoSpan to reimburse Pictometry for attorney's fees and costs incurred in defending against such claims. &lt;br /&gt;&lt;br /&gt;In a related matter, the United States Patent and Trademark Office granted Pictometry's request to re-examine the GeoSpan patent to consider written materials which were not before the Patent and Trademark Office examiner when the initial examination of the patent was made. When Richard Hurwitz moved his family across the country last year to become CEO of the Henrietta firm, he had a process to learn, data to analyze and a lot of decisions to make. The goal was to thrust Pictometry beyond its core strength and do it before the company lost market traction in the commercial space.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;To support the shift, the company received a $63 million invest-ment this spring and has increased its employment by nearly 50 percent from last fall. When Hurwitz arrived, Pictometry had 220 employees. Today, the firm has 325 staffers-including 200 in Rochester-in line with growth plans envisioned back in 2009.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;Pictometry's core business since it was founded in 2000 was to tap government work, which allowed the company to compile a vast and valuable library of extraordinarily detailed aerial images. But the real growth for Pictometry lies in commercial applications, former CEO Richard Kaplan said.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;At the company's helm since last August, Hurwitz has identified the avenues to pursue and assembled the necessary skills to pursue them. Figuring out exactly how to pursue them, however, remains a work in progress.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;The company has a fleet of 60 airplanes equipped with proprietary image-capture equipment. As a plane flies roughly 2,500 feet above the ground, its equipment records multiple images of every square foot of a county. That information goes into a database, and software extracts interconnected images with tools to provide measurements and manipulate data.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;Pictometry's strength has been its data set, combined with decision support system software. Clients used the Web-based system to manipulate data.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;But it was a one-size-fits-all, sort of a monolithic tool that we continued to add aspects and features to, but it became cumbersome and unyielding,&quot; Hurwitz. &quot;More than that, while embraced by early adopters, it really hadn't shown the ability to move within the work flow of large corporate customers.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;So we spent time over the last 10 months to understand the value framework in which Pictometry needed to operate with targeted commercial customers.&quot;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;Pictometry subsequently has partnered with major companies in their industries to co-develop the most useful systems for them to leverage Pictometry's image database.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;The secret of the Pictometry model in its early days was one where it captured its data set on the back of a margin,&quot; Hurwitz explained. &quot;We had contracts with counties, and we went and collected every square foot of the earth below and licensed that data set to those counties, but we own it. As a result, we can resell that imagery at zero cost to goods. That, by the way, is the operational leverage we have.&quot;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;

But choosing the best revenue-generating uses for this data was a challenge for Hurwitz, especially against a rapidly changing competitive backdrop.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;The geospatial industry is a business whose time has come,&quot; Hurwitz said. &quot;Very large companies are placing very large bets today in geospatial: Apple, for example, has announced the acquisition of a series of mapping companies recently; Google Earth is commonplace, but more than that, imagery is becoming part of our vernacular in a way it never had been before.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;Everything now is location-based. Thirty percent of all (U.S.) searches originate from a location-based query,&quot; he said.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;A year and a half before Hurwitz arrived, Kaplan had begun to tap the commercial potential for Pictometry's bank of detailed aerial images. Kaplan and his team had identified almost a dozen markets in an effort to diversify beyond its original customer base.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;It was my goal to get (Pictometry's business solutions) up and going before I left,&quot; Kaplan said. &quot;We took a lot of stuff and threw it up against the wall to see what stuck, to see what was good and what wasn't good. Some were, some of them weren't.&quot;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;Hurwitz's job, Kaplan said, was to choose the markets that showed the most potential and channel the company's attention into them.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;Those targets include industries that require more than visualization, said Kim Hajec, vice president of marketing.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;Industries such as insurance, government, assessment and construction-all use our imagery to measure, which is where Pictometry shines by combining high-resolution imagery being captured with measurement solutions,&quot; she said. &quot;In industries such as real estate or law enforcement, they both use our imagery for visualization, not necessarily measurement.&quot;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;So real estate would use our imagery to help the sale of a property or for planning. In law enforcement, again using imagery for visualization of roads, routes, buildings and general awareness,&quot; Hajec said.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;All of its customers are important, she said, but the company has to be focused. It cannot pursue every opportunity.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;Though Hurwitz had spent eight years on the company's board of directors, charting a new direction meant understanding the inner workings of the firm, and the data Kaplan's team had collected required months of discussions, research and analysis.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;To sift through potential applications, Hurwitz set aside time for companywide contemplation, but with a deadline in mind.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;I didn't come in presuming I had the answer. Spectrum Equity manages more than $4.7 billion of committed capital. It invests in information and digital media industries, such as Ancestry.com Inc.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;In a statement issued by Pictometry, a Spectrum official said the investment firm had been pursuing a transaction with the company for almost seven years.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;In 2008, Pictometry considered going public but shelved the plan when the stock market collapsed. It now has no interest in an IPO, Hurwitz said.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;Today we have no plans to pursue that path as we see the company at an inflection point from which it can head in new directions for growth and, in so doing, generate significant shareholder value. The entire team here at Pictometry is committed to driving forward to realize its targeted objectives,&quot; he said.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;Before leaving, Kaplan did not revisit the option either. He's very aggressive, which is really what the company needs now.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;I'm a good startup person, but once the company is established, administration and process, I'm not good at that, which is the reason I left,&quot; Kaplan explained. &quot;I was with the company a lot longer than I'm usually at a company. I was with Pictometry for 10 years; my average is four years.&quot;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;Kaplan is a serial entrepreneur. Among his other leadership positions in the region, he is CEO of Torvec Inc., a 14-year-old automotive technology company.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;Hurwitz was Kaplan's first choice to head Pictometry. A search firm agreed.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;With Rick, I thought the transition would be a lot easier because the employees know him, he would have no problem calling me for history, plus he is a brilliant guy. The big thing was getting him to move from Telluride,&quot; Kaplan said.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;Hurwitz moved his family from the small Colorado town last year. It had been about 20 years since he had been back to the region. A native of Buffalo, Hurwitz had studied economics and philosophy at the University of Rochester.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;He first found out about Pictometry through a classmate there, the son of the company's founding angel investor, who eventually demonstrated the system to Hurwitz at his parents' home in Florida. At the time, Hurwitz was living between New York City and St. Louis and running his own startup.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;I reacted very viscerally to it. I did because it was a film I had seen, and I knew it had a happy ending,&quot; Hurwitz remembered. &quot;I had spent 10 years building a business called Bridge Information Systems. I had collected every single trade as it occurred on about 249 exchanges around the globe.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;We stacked that data in a database, wrote algorithms to let money managers and brokers manipulate the data in order to turn it into information, and that's exactly what Pictometry does. It's a different data set; Pictometry collects oblique imagery and stacks it historically.&quot;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;Over the course of his career, Hurwitz has owned, operated and sold a series of businesses. The last four years he has been buying distressed assets from banks. Hurwitz looked for companies that had failed from financial but not operating dysfunction, companies that had a long history of operating profitably but had borrowed beyond their means, he said.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;Hurwitz would return the companies to profitability and sell them.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;It was a culmination of my Wall Street career, where it allowed me to combine my financial acumen with my operational experiences,&quot; he said.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;In the middle of all that, he said, he also built up an 11-unit chain of grocery stores in Colorado, Kansas and Nebraska, which he eventually sold to a private-equity firm.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;Hurwitz's appetite for challenge is large. The opportunities Pictometry has in front of it are the perfect match for him, Kaplan said, and he is committed to it, which he proved by moving here.&lt;br /&gt;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&quot;He loves the company and always has been intrigued by it,&quot; Kaplan said.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;
